Let’s Get Ethical: A Mediator’s Roundtable
AMA Business meeting begins at 11:30am with year-end announcements and annual Board of Directors elections. Roundtable Discussion begins at 12:00pm. Mediation, like any dispute resolution method, demands that third-party neutrals adhere to a high standard of ethical conduct. If a mediator behaves in an unethical manner, that mediator sacrifices their credibility and can taint the entire mediation process. The December Austin Mediator’s Meeting presentation, Let’s Get Ethical: A Mediator’s Roundtable, will be a review of the ethical guidelines for practicing Texas mediators and will include a frank and open discussion on what it means to be an “ethical” mediator. Examples of ethical dilemmas faced during mediation, both real and hypothetical, will be discussed. Topics to be addressed include: Confidentiality: what is it really, and why is it important? Impartiality: is your bias showing? Professional conduct for the practicing mediator: what behavior is expected of a professional mediator? Logistical Mediation Issues: getting there is half the journey Clay Avery, AMA Board Member, will facilitate the roundtable discussion utilizing examples of ethical dilemmas. Please bring your own dilemmas to discuss!

Facilitator
Clay Avery is licensed to practice law in Texas, but chooses to focus on using mediation as a primary means for conflict resolution. With over 100+ hours of mediation experience, Clay is a strong believer in the Community-Based approach to collaborative problem solving. He is an active volunteer mediator at the Austin Dispute Resolution Center in addition to coaching future mediators during the 40-hour basic mediator training. In 2018, Clay helped implement the first online dispute resolution system used in a Travis County court. Clay holds a BBA from Texas Christian University and a JD from the University of Texas School of Law.
